General terms
VAT
- All prices in this overview are exclusive of VAT. For Danish clients, VAT is added at the applicable rate (25%) in line with the rules for domestic B2B transactions.
- For clients based in another EU country who are VAT registered there, reverse charge applies. In that case no Danish VAT is added, and the client is responsible for accounting for VAT in their own country.
- Clients based outside the EU are invoiced without VAT, in line with the applicable export rules.
Payment
- Payment terms: net 14 days from the invoice date.
- In the case of late payment, interest is charged at the applicable rate under the Danish Interest Act (renteloven), together with a compensation fee equivalent to €42 per invoice, pursuant to section 9a of that Act.
- Any bank charges or fees related to international money transfers are payable by the client.
Limitation of liability
- Tobias Jacobsen Studio's liability for any claim arising from the collaboration is limited to the amount invoiced for the task or deliverable to which the claim relates.
Copyright and usage rights
- Tobias Jacobsen Studio retains copyright to all design material (concepts, sketches, source files, and similar) until the invoice has been paid in full.
- On full payment, a right of use to the finished material is granted to [Name of design studio] or the relevant end client, limited to the agreed purpose, medium, and time period.
- Full and exclusive transfer of copyright (including the right to resell or make unrestricted reuse of the material) requires a separate written agreement and is invoiced separately.
Revisions
- The price includes 2 rounds of revisions per deliverable within the originally agreed scope. Further revisions or changes falling outside the original brief are invoiced at the standard hourly rate.
Cancellation and postponement
- In the event of cancellation, postponement, or a pause in an ongoing project, work already carried out and time that has been reserved but not released is invoiced, unless otherwise agreed, with at least 7 days' notice.
Confidentiality
- Both parties treat business related and confidential information about each other, and about each other's clients, as confidential, both during and after the collaboration ends.
Force majeure
- Neither party is liable for delays or failure to perform caused by circumstances beyond reasonable control (for example illness, power outages, or similar events).
